Board of education - specific duties - adoption of policy

(1) In carrying
out the duties specified in section 22-32-109 (1)(t), on and after July 1, 1990, each board of
education is required to formally adopt a policy concerning the delivery of all educational
programs and courses of instruction or study that expose pupils to any psychiatric or
psychological methods or procedures involving the diagnosis, assessment, or treatment of any
behavioral or mental health disorder.
(2) Prior to taking action pursuant to subsection (1) of this section, a board of education
shall provide an adequate opportunity to allow review by and receive recommendations from
members of the board, the personnel of the school district, the parents of pupils enrolled in the
school district, and members of the public.
(3) The department of education shall prepare model policies to provide guidance to
boards of education adopting policies under subsection (1) of this section.
