Optional posting of bond or bond card - Exception - Definition

(a) When any law enforcement officer in this state arrests or issues a citation for any traffic law violation or motor vehicle accident and the officer is authorized by law to take possession of and retain the operator's or chauffeur's license of the person so charged or cited, the person arrested or to whom the citation is issued shall have the option to either surrender his or her operator's or chauffeur's license or post a bond or a bond card to assure his or her appearance in court on the offense charged. (b) The option to post a bond card shall not be available to a person charged with driving while intoxicated. (c) As used in this section, the term "law enforcement officer" shall mean any member of the Division of Arkansas State Police, a sheriff or a deputy sheriff, a member of a municipal police force, or a constable.
