(a) (1) Except as provided under subdivision (a)(2) of this section, a person shall not operate a motor vehicle or motorcycle that is equipped to supply the engine with nitrous oxide on a street or highway. (2) This section shall not prohibit: (A) A person from operating a motor vehicle or motorcycle that is equipped to supply the engine with nitrous oxide if the system supplying nitrous oxide is made inoperative by: (i) Disconnecting the line feeding nitrous oxide to the engine; or (ii) Removing the container or containers of nitrous oxide from the motor vehicle or motorcycle; or (B) A person from operating a tow vehicle or a recreational vehicle that is equipped to supply the engine with nitrous oxide. (b) A person who violates the provisions of this section is guilty of a Class C misdemeanor. Acts 2005, No. 1568, § 1.
