Funds for investigations and prosecutions

(a) Under this subchapter and the Medicaid Fraud Act, § 5-55-101 et seq., the Attorney General or a prosecuting attorney is entitled to recover reasonable and necessary expenses incurred during his or her investigations and prosecutions. (b) The Attorney General shall create and maintain accounts for these funds. (c) The federal share of these funds shall be returned to the United States Government in accordance with the federal regulations governing the Medicaid Fraud Control Unit. (d) The remaining funds shall be retained and expended by the Attorney General to defer the cost of future investigations and prosecutions conducted by the Medicaid Fraud Control Unit.
