(a) It is unlawful to: (1) Engage in unlicensed real estate activity; or (2) Violate this chapter: (A) Individually; or (B) As an officer, agent, or member of a firm, corporation, partnership, copartnership, association, limited liability company, or other entity by participating in or being an accessory to a violation of this chapter by the firm, corporation, partnership, copartnership, association, limited liability company, or other entity. (b) A commissioner of the Arkansas Real Estate Commission, the Executive Director of the Arkansas Real Estate Commission, a commissioner's designee, the executive director's designee, or any licensee residing in the county where the violation occurs may by affidavit institute criminal proceedings for a violation of this chapter without filing a bond for costs. (c) The prosecuting attorney for each county shall prosecute any violation of this chapter that occurs in his or her county. (d) A violation of this chapter is a Class D felony.
