Costs and fees - Liability of state

(a) The costs in all state prosecutions for any offenses which may be committed in or in respect of the Division of Correction shall be paid out of the State Treasury. (b) In the cases mentioned in subsection (a) of this section, it shall be the duty of the judge to cause to be made out an accurate bill of costs therein and to certify to its correctness; it shall be the duty of the Auditor of State to draw his or her warrant for the amount when an appropriation shall be made therefor.
