Incarceration of injured employee

(a) (1) When any person who receives workers' compensation benefits is incarcerated in an institution under the control of the Division of Correction, the inmate's spouse or, if no spouse, the inmate's minor dependent children, may petition the Workers' Compensation Commission to award to the spouse or minor dependent children the inmate's workers' compensation weekly disability benefits for the period of the claimant's incarceration. (2) If the inmate has no surviving spouse or surviving minor dependent children, the division may petition the commission to award to the division the amount of the workers' compensation weekly disability benefits for the period of the claimant's incarceration necessary to reimburse the division for the cost of incarcerating the inmate.
