(a) If the commission determines that any person has engaged in or is about to engage in any act or practice constituting a violation of this chapter or a rule adopted or an order issued under this chapter, the commission may do any of the following: (1) Issue an order, with or without a prior hearing or notice, against the person or persons engaged in the act or practice, directing them to cease and desist from engaging in the act or practice. (2) Issue an order appointing a receiver or conservator over a respondent or the respondent’s assets. (3) Order restitution or disgorgement against any person who has violated this chapter or any rule adopted or order issued pursuant to this chapter. (4) Bring an action in the Circuit Court of Montgomery County to enjoin an action or practice and to enforce compliance with this chapter or any rule adopted or order issued pursuant to this chapter. Upon a proper showing, the court may issue a temporary restraining order or permanently enjoin any unlawful act or practice. (b) The commission shall not be required to post a bond for any actions taken pursuant to subsection (a).
