(a)(1) In addition to any court costs and fees now or hereafter authorized in Randolph County, the Randolph County Commission, by resolution of the commission, may impose an additional fee in an amount not to exceed fifty dollars ($50) to be assessed and taxed as costs on each civil case and on each criminal case, including traffic cases filed in the circuit court or district court in Randolph County. The additional fees, when collected by the clerk of the court or his or her collection officers of the courts, shall be paid into the General Fund of Randolph County to be used by the Randolph County Commission for operating and maintaining an expansion to the Randolph County Jail. The Randolph County Commission may set and adjust, by resolution, the fees within the limits authorized by this section based on the needs associated with operating and maintaining an expansion to the Randolph County Jail. (2) These fees shall not be waived by any court unless all other fees, assessments, costs, fines, and charges associated with the case are waived. (b) The fees authorized by this section shall be applied exclusively for payment of the cost of financing, planning, constructing, furnishing, maintaining, equipping, and operating the county jail and its annexes, or for the payment of the principal of and interest on any bonds, warrants, or other obligations issued by or on behalf of the county to finance the cost of the expansion and renovation, as well as the expenses of issuance of any bonds, warrants, or other obligations.
