(1) LIMITATION. Except as provided in sub. (2), a merchant may not record a customer’s address, telephone number or any other identification information as a condition for accepting a credit card as payment for a consumer credit transaction. (2) EXCEPTIONS. A merchant may record a customer’s address or telephone number if any of the following conditions exists: (a) The credit card issuer does not require the merchant to obtain from the issuer prior authorization as to the availability of credit in order to complete the credit card transaction. (b) The merchant requires the information for shipping, delivery, service orders or installation purposes or to notify the customer of a special order. (3) REMEDIES. Whoever violates this section is subject to the remedies and penalties under s. 425.303.
