(1) Subject to sub. (2), a school bus may be equipped with a device for recording audio or video, or both, of the interior of the school bus while the school bus is being used to transport pupils to and from school and school-sponsored activities. (2) Subsection (1) applies only if the applicable school board, the governing board of a charter school authorized under s. 118.40 (2r) or (2x), or the governing body of a private school or tribal school adopts a policy authorizing audiovisual recording on school buses and notice of the policy is provided to pupils and their parents or guardians and clearly posted on the interior of the school bus. (3) Recordings made as authorized under this section shall remain confidential and may be used by only school officials and law enforcement personnel for investigations, school disciplinary actions, and criminal prosecutions related to incidents occurring in or around the bus.
