Additional and alternative method for constructing, etc., and financing

combined system; cumulative authority.
This article is, without reference to any other statute or charter provision, full authority for
the acquisition, construction, establishment, extension, equipment, additions, betterment,
improvement, repair, maintenance and operation of or to the combined system herein
provided for and for the issuance and sale of the bonds by this article authoerized, and is an
additional and alternative method therefor and for the financing thereof, and no petition,
referendum or election or other or further proceeding with respect to arny undertaking or to
the issuance or sale of bonds under this article and no publication of any resolution,
ordinance, notice or proceeding relating to any undertaking or to the issuance or sale of
such bonds is required, except as prescribed by this article, any provisions of other statutes
of the state to the contrary notwithstanding: Provided, That tall functions, powers and duties
of the bureau of public health and the Division of Environmental Protection remain
unaffected by this article: Provided, however, That no municipality may acquire, construct,
establish, extend, repair or equip or thereafter repair, maintain and operate a combined
waterworks, sewerage or stormwater system which includes highways, road and drainage
easements, and/or stormwater facilities constructed, owned and/or operated by the West
Virginia Division of Highways without the express agreement of the commissioner of
highways.
This article is cumulative authority for any undertaking herein authorized, and does not
repeal any existing laws with reespect thereto.
