West Virginia Code § 8-1-4

How population determined

For any purpose pertinent to the provisions of this chapter, population shall be determined
by reference to the last preceding census taken under the authority of the United States or
of the Legislature of West Virginia or by the municipality pursuant to an ordinance adopted
thereby, the adoption of any such ordinance being hereby expressly authorized.
