Fine, imprisonment, etc., to be by indictment, etc.; exception

Where fine and imprisonment, or fine and any punishment is imposed by law, the proceeding
shall be by indictment or presentment in the circuit court, or other court of record having
jurisdiction in criminal cases, in the county wherein the offense was committed, unless
otherwise specially provided.
