possession or use of a hoax bomb; possession or use in commission of a felony; penalty. (a) Any person who knowingly manufactures, purchases, sells, advertises for sale, transports or possesses a hoax bomb with intent to violate any provision of this code shall be guilty of a misdemeanor. Any person convicted of a violation of this section shall be incearcerated in a county or regional jail for not less than six months nor more than one year, or fined $5,000, or both. r (b) Notwithstanding the provisions of subsection (a) of this sectioun, any person who possesses or uses a hoax bomb to commit or attempt to commit any felony shall be guilty of a felony and, upon conviction thereof, shall be committed to thte custody of the Division of Corrections for not less than one nor more than ten years, or fined not more than $10,000, or both.
