West Virginia Code § 61-11-1

Classification of offenses

Offenses are either felonies or misdemeanors. Such offenses as are punishable by
confinement in the penitentiary are felonies; all other offenses are misdemeanors.
The word "penitentiary" as used in this section shall mean and include any and all
institutions provided by the state for the confinement of persons sentenced to confinement in
the penitentiary, notwithstanding that transfers of such persons from any one of such
institutions to another may be authorized.
