West Virginia Code § 48-2-602

Marriage out of state to evade law

If a resident of this state marries in another state or country, the marriage is governed by
the same law, in all respects, as if it had been solemnized in this state if, at the time of the
marriage:
(1) The marriage would have been in violation of section 3-103 if performed in this state;
(2) The person intended to evade the law of this state; and
(3) The person intended to return and reside in this state.
