West Virginia Code § 48-14-505

Misdemeanor offense of escape from custody; penalty

If a person is committed to jail under the provisions of paragraph (B), subdivision (5), of
section 14-502 and willfully fails to return to the place of confinement within the time
prescribed, such person shall be considered to have escaped from custody and shall be guilty
of a misdemeanor, punishable by imprisonment for not more than one year.
