Any charitable or public service organization or any of its auxiliaries or other organizations
otherwise affiliated with it possessing an annual or limited occasion bingo license or a super
bingo license shall conduct a bingo occasion only in the county within which the organization
is principally located.
Any licensee which, in good faith, finds itself unable to comply with this requirement shall
apply to the Tax Commissioner for permission to conduct a bingo occasion in a location other
than the county within which the organization is principally located: Provided, That the
location shall be in a contiguous county, or, if not in a contiguouus county, and not in the
county where the licensee organization has its principal location, the location of the
proposed bingo occasion may be no more than thirty air milets from the county within which
the organization is principally located. The application shall be made on a form provided by
the Tax Commissioner and shall include the particulars of the requested change and the
reasons for the change. The application shall be filed no later than sixty days before any
scheduled bingo occasion.
For purposes of this section, the principal location of a licensee is the address of the licensee
shown on the licensee's West Virginia business registration certificate.
