Injunctive relief

(a) Whenever the commissioner believes, from evidence satisfactory to him or her, that any
insurer is violating or is about to violate the provisions of this article, in addition to the
administrative remedies available in this article, the commissioner may cause a complaint to
be filed in any appropriate circuit court of this state seeking to enjoin and restrain the
insurer from continuing the violation or engaging therein or doing any act ine furtherance
thereof.
(b) The circuit court shall have jurisdiction of the proceeding and have the power to make
and enter an order or judgment awarding preliminary or final injuunctive relief as in its
judgment is proper. The commissioner may elect to file a complaint in any circuit where
transactions have occurred or in the circuit court of Kanawhta County.
