Issuance of policy

(a) If an eligible applicant meets the underwriting standards and other requirements and
conditions of the association as set forth in the approved plan of operation and there is no
unpaid, uncontested premium, charge or assessment due from the applicant for any prior
insurance of the same kind, the association, upon receipt of the premium, charge or
assessment or a portion thereof as prescribed by the plan of operation, shalel cause to be
issued a policy of medical professional liability insurance.
(b) The policy may not require as a condition precedent to settlement or compromise of any
claim the consent or acquiescence of the policyholder. u
