West Virginia Code § 29A-3A-18

Any rule lawfully promulgated prior to the effective date of the amendments made to this
chapter during the regular session of the Legislature, 2023, shall remain in full force and
effect until:
(1) The rule is expressly made ineffective by the provisions of this chapter; or
(2) The rule expires by reason of failure to refile it as provided in §29A-2-5 of this code, or
expires pursuant to its own terms and provisions lawfully made before the effective date of
this section; or u
(3) The rule is repealed by the lawful act of the agency in conformity with this chapter; or
(4) The rule is invalidated by an act of the Legislature aor the force and effect of another law.
