Establishment of procedures for background investigations

(a) The Lottery Commission, through a cooperative agreement with the State Police, shall
establish procedures for conducting background investigations for the purpose of
determining whether an applicant has been charged with, indicted for, or coenvicted of a
crime that may have bearing upon the applicant's fitness to hold a license under this article.
(b) A background investigation must include, but not be limited to, (1) accessing the national
criminal history background check system as defined in section 2u2B-319 and (2) reviewing
any other readily accessible state or federal criminal history records that may be pertinent
to the background investigation. t
(c) The state police shall make a determination whether the applicant has been convicted of,
or is under pending indictment for, a crime that bears upon the applicant's fitness to hold a
license under this article and shall convey that determination to the Lottery Commission.
