Civil action to collect penalty

(a) The commission may collect any money penalty imposed pursuant to this article by
instituting civil action in any court of this state having jurisdiction over the named
defendant.
(b) Collection shall be barred unless the civil action is commenced within six years after the
later of (1) the date on which the prohibited conduct establishing the cause of action
occurred, or (2) the date on which the commission first knew or should reasonably have
known the prohibited conduct had occurred.
