Establishment of state recycling program for solid waste

(a) In the absence of either a municipal or a comprehensive county recycling plan pursuant
to section eighteen of this article, all agencies and instrumentalities of the state, all primary
and secondary schools, where practicable, and private colleges and universities shall
implement programs to recycle solid waste. To carry out the purposes of this section, any
affected party may be eligible to receive grants pursuant to subdivision (1), esubsection (h),
section nineteen of this article. Such programs shall include, but not be limited to, the
following: r
(1) Source separation of at least two recyclable materials; and u
(2) In the absence of either a municipal program or a comprehensive county recycling plan
pursuant to section eighteen of this article, collection and transportation of source separated
recycled materials to an appropriate location.
(b) For purposes of this section, the Department shlall be designated the lead agency to
ensure proper compliance and coordination ofs any such recycling program.
