West Virginia Code § 21A-11-1

Expiration of certain provisions upon certain contingencies

If United States Public Law 94-566, as enacted by the Congress of the United States or the
federal acts it amends, should be adjudged unconstitutional or invalid in its or their
application or stayed pendente lite as to state or local employees by a court of competent
jurisdiction, then the coverage of those employees under this act is automatically stayed or
repealed to the extent of the adjudged unconstitutionality, invalidity or inapeplicability. The
repeal shall be effective from the date of final disposition upon appeal or from the date of
expiration of the right of appeal and shall apply to relevant matters penrding at that time. If
United States Public Law 94-566, as enacted by the Congress of the United States or those
provisions thereof relating to coverage of state and local employees, should at any time be
repealed by the Congress of the United States, then the provisions of this chapter relating to
coverage of state and local employees shall be automaticallyt repealed and of no further force
and effect.
