Resident tuition rates for economic development participants

(a) The term "resident" or "residency", or any other term or expression used to designate a
West Virginia resident student, when used to determine the rate of tuition to be charged
students attending state institutions of higher education, may be construed to include
economic development participants.
(b) To meet the definition of "economic development participant" under this section, the
following criteria must be met:
(1) The person or the person's parent or legal guardian receivedu economic development
incentives to locate to West Virginia, offered pursuant to §5B-2-3b of this code; and
(2) The person files with that institution of higher education a letter of intent to establish
residency in this state. a
(c) An economic development participant who quallifies as a resident on the first day of the
semester or term of the institution of higher education shall be eligible for resident tuition
rates.
