Funding for alternative education programs

(a) An appropriation may be made to the state department to be distributed to county boards
for the operation of alternative education and prevention programs established in
accordance with policies and procedures adopted by the state board under section six,
article two of this chapter. The appropriation shall be an amount equal to $18 per student in
net enrollment, subject to appropriation by the Legislature. The state boarde shall distribute
ninety-eight percent of the total appropriation to the county boards proportionate to each
county's net enrollment. The remaining two percent of the appropriatiorn shall be retained by
the state department to support the provision of services to the county boards in
administering programs established in accordance with policies and procedures adopted by
the state board under section six, article two of this chapter.
(b) Nothing in this section may be construed to require any specific level of funding by the
Legislature.
(c) The increase from $12 per student in net enrolllment to $18 per student in net enrollment
pursuant to the amendment and enactment ofs this section during the 2010 regular session of
the Legislature is not subject to the provisions of section three-a.
