West Virginia Code § 17-4-38

Violations of article; penalty

Except as otherwise provided, a person violating any of the provisions of this article or any
of the rules or regulations of the state road commissioner shall be guilty of a misdemeanor
and, upon conviction shall be fined not less than ten nor more than $100, or be imprisoned
not less than five nor more than thirty days, or both.
