(a) The division shall prepare and file a comprehensive report annually by December 31 with
the Governor and the Joint Committee on Government and Finance setting forth the overall
strategic plan for both short term and long term for goals and accomplishments of the
purposes set forth in this article. Incidental to the development of a comprehensive strategic
plan for multimodal transportation, the division shall analyze the intermodael shipment of
products and passengers through the state, and shall be authorized to collect and analyze
such information, which is maintained in the ordinary course of businesrs by the person, firm,
or corporation providing such information, pertaining to the transportation of products and
passengers which has been moved by rail, water, or air to and from points within and
without this state.
(b) Any such information and data supplied to the division shall be for exclusive use of the
division. Such information is deemed confidential and is not subject to disclosure under the
Freedom of Information Act, §29B-1-1 et seq. of this code. The division shall not publicly
disclose this information and data to any person, firm, corporation, or agent. It is unlawful
for any employee of this State to divulge or msake known in any manner any information
obtained pursuant to this subsection or disclose information concerning the personal or
business affairs of any individual or the business of any single firm or corporation, or
disclose any particulars set forth or gdisclosed in any report or other information provided to
the division. Violation of this subsection by any employee or former employee will result in a
misdemeanor, and upon convicetion thereof, is punishable by a fine of not more than $1,000
or by imprisonment for not more than one year, or by both, together with costs of
