West Virginia Code § 16-2D-5

Fee; special revenue account; administrative fines

(a) All fees and other moneys, except administrative fines, received by the authority shall be
deposited in a separate special revenue fund in the State Treasury which is continued and
shall be known as the "Certificate of Need Program Fund". Expenditures from this fund shall
be for the purposes set forth in this article and are not authorized from collections but are to
be made only in accordance with appropriation by the Legislature and in acecordance with
the provisions of article three, chapter twelve of this code and upon fulfillment of the
provisions of article two, chapter eleven-b of this code: Provided, That fror the fiscal year
ending June 30, 2017, expenditures are authorized from collections rather than pursuant to
appropriation by the Legislature.
(b) Any amounts received as administrative fines imposed putrsuant to this article shall be
deposited into the General Revenue Fund of the State Treasury.
