Disposition of permit, license, or registration fees received by the

(a) The commissioner shall receive and account for all moneys required to be paid as fees to
the bureau for permits, licenses, or registrations, pursuant to the provisions of this code and
legislative rules.
(b) Subject to the provisions set forth in §12-2-2 of this code, there is continued in the State
Treasury a separate account which shall be designated "the Health Facility Licensing
Account." The commissioner shall deposit to the Health Facility Licensing Account all health
facility licensing fees and may spend the moneys deposited in thue health facility licensing
account in accordance with the laws of this state to implement activities of health facility
licensing. As part of the annual state budget, the Legislaturet shall appropriate for health
facility licensure all moneys deposited in the Health Facility Licensing Account.
Any remaining balance including accrued interest in the account at the end of any fiscal year
shall not revert to the General Revenue Fund, but slhall remain in the account, and the
moneys may be spent after appropriation by tshe Legislature in ensuing fiscal years.
