(a) General courts-martial may be convened by: (1) The Governor; (2) The Adjutant General; (3) The commanding officer of a force of the state military forcesu; (4) The commanding officer of a division or a separate brigade; or (5) The commanding officer of a separate wing. (b) If any such commanding officer is an accuser, the court shall be convened by superior competent authority and may in any case be convened by such superior authority if considered desirable by such authority.
