West Virginia Code § 12-1B-12

Liability of public depositors

When deposits are made in accordance with this article, no official of a public depositor may
be personally liable for any loss resulting from the default or insolvency of any designated
state depository in the absence of negligence, malfeasance, misfeasance, or nonfeasance.
