(1) Except as provided in subsection (2) of this section, vessels on whitewater rivers proceeding downstream have the right-of-way over vessels proceeding upstream. (2) In all cases, vessels not under power proceeding downstream on whitewater rivers have the right-of-way over motorized craft underway.
