If a nursing facility fails to make timely payment of the safety net assessment, the department may seek a remedy provided by law, including, but not limited to: (1) Withholding any medical assistance reimbursement payments until such time as the assessment amount is recovered; (2) Suspension or revocation of the nursing facility license; or (3) Imposition of a civil fine up to one thousand dollars per day for each delinquent payment, not to exceed the amount of the assessment.
