(1) It is unlawful for any person to offer for sale, sell, or exchange for consideration, any consumer fireworks to a consumer or user other than at a fixed place of business of a retailer for which a license and permit have been issued. (2) No licensee may sell any fireworks to any person under the age of sixteen. (3) A violation of this section is a gross misdemeanor.
