The commissioner must adopt all rules needed to implement this chapter. The rules must: (1) Identify which insuring entity or self-insurer has the primary obligation to report a closed claim when more than one insuring entity or self-insurer is providing medical malpractice liability coverage to a single health care provider or a single health care facility that has been named in a claim; (2) Protect information that, alone or in combination with other data, could result in the ability to identify a claimant, health care provider, health care facility, or self-insurer involved in a particular claim or collection of claims; and (3) Specify standards and methods for the reporting by claimants, insuring entities, self-insurers, facilities, and providers.
