In the case of claims for death or total disability under subdivision A 4 of § 65.2-504 or § 65.2-513, the following matters shall be required or effective only to the extent that they are allowed by the 1969 Federal Coal Mine Health and Safety Act as amended and the regulations issued thereunder: 1. Notice to the employer under § 65.2-405; 2. Any limitation for the filing of a claim for benefits for death or total disability under §§ 65.2-406 and 65.2-601; 3. Waivers as provided under § 65.2-407; 4. Settlements agreed to, allowed, or granted under § 65.2-701; and 5. The right of an employer to refuse employment to an applicant or to discharge a claimant because he has or is susceptible to coal worker's pneumoconiosis. 1973, c. 436, § 65.1-65.2; 1991, c. 355.
