§ 5294. Interests of justice hearing
Not later than the next business day after a juvenile who is awaiting trial or other
legal process and who is treated as an adult for prosecution in the Criminal Division
is taken into custody, the court shall hold a hearing and determine whether to issue
a written order, pursuant to 34 U.S.C. § 11133(a)(11)(B), that it is in the interests of justice to hold the juvenile in a jail or other secure
facility for adults owned or operated by the Department of Corrections and, if such
an order is issued, whether to allow sight or sound contact with adult inmates. Hearings
held and orders issued pursuant to this section shall conform with the requirements
of 34 U.S.C. § 11133(a)(11)(B), including the criteria set forth therein.
