§ 1433. Exemption of State from payment of fees In judicial proceedings initiated in the name of the State by public officials authorized so to do, the State may not be required to pay the State fees set forth in sections 1431 and 1432 of this title. However, if the State prevails in the proceedings, the fees shall be taxed in the bill of costs under sections 1471 and 1474 of this title.
