§ 1325. Crimes and penalties (a) A corporation, association, or partnership that is not permitted to conduct sports wagering pursuant to this chapter that operates, conducts, or exposes sports wagering for play or accepts a bet or wager associated with sports wagering shall: (1) for a first violation of this subsection, be fined not more than $50,000.00 or imprisoned not more than six months, or both; (2) for a second violation of this subsection, be fined not more than $150,000.00 or imprisoned not more than one year, or both; and (3) for a third or subsequent violation of this subsection, be fined not more than $300,000.00 or imprisoned not more than two years, or both. (b) An operator who violates a provision of this chapter shall be fined: (1) for a first violation, not more than $25,000.00; (2) for a second violation, not more than $75,000.00; and (3) for a third violation, not more than $150,000.00. (c) Upon the violation of a provision of this chapter by an operator, the Department may terminate its contract with the operator and revoke the operator’s privilege to offer sports wagering within the State.
