§ 7502. Rulemaking
(a) Consistent with the purposes of this chapter, the Department of Public Service may
interpret the provisions of this chapter. Any person aggrieved by any such interpretation
or policy may file with the Department of Public Service a petition for a declaratory
ruling. Such a petition may include a request to determine whether newly created services,
and other services not specifically mentioned by the definition of telecommunications
service in this chapter, are telecommunications service. All services declared to
be telecommunications service shall thereafter be subject to the charge imposed by
subchapter 3 of this chapter.
(b) By rule or general order, the Department of Public Service may adopt procedures and
standards to implement its responsibilities under this chapter. To the extent applicable,
the Department of Public Service shall use the procedures and standards applicable
to the setting of rates for regulated utilities. Those procedures may be designed
to expedite the annual establishment of amounts to be collected and distributed by
the fiscal agent.
