§ 4304. Employees
(a) An employer shall not allow a person affected with any contagious, infectious, or
other disease or physical ailment that may render employment detrimental to the public
health to work in an establishment, and a person so affected shall not work in an
establishment subject to the provisions of this chapter.
(b) The Commissioner may require a person employed in an establishment subject to the
provisions of this chapter to undergo medical testing or an examination necessary
for the purpose of determining whether the person is affected by a contagious, infectious,
or other disease or physical ailment that may render his or her employment detrimental
to public health. The Commissioner may prohibit a person from working in an establishment
pursuant to an emergency health order described in section 127 of this title if the person refuses to submit to medical testing or an examination.
