§ 6681. Paint consumer fees
(a) The paint product stewardship assessment shall be sufficient to implement and sustain
the Paint Product Stewardship Program. If at any time the stewardship assessments
established in this section are not sufficient to implement and sustain the Paint
Product Stewardship Program, the Paint Product Stewardship Program shall propose new
stewardship assessments that are sufficient to implement and sustain the Program.
(b) A retailer shall charge an assessment on paint products, based on current material
management costs of the Paint Product Stewardship Program, in the following amounts
for architectural paint:
(1) Half pint or smaller: No fee.
(2) Greater than a half pint to one gallon: $0.65.
(3) Greater than one gallon to two gallons: $1.35.
(4) Greater than two gallons to five gallons: $2.45.
