§ 1674. Certification of water system operators
(a)(1) The Secretary shall by rule establish processes and criteria for:
(A) the classification of public water systems for the purpose of certifying operators;
and
(B) the certification of persons qualified to operate specific classes of public water
systems.
(2) The rules shall minimize the regulatory burden on smaller systems, to the extent allowable
by State and federal law.
(b)(1) The Secretary may suspend or revoke a certificate granted under this section, after
notice and opportunity to be heard, if the Secretary finds that the certificate holder
has:
(A) submitted materially false or materially inaccurate information; or
(B) violated any material requirement, restriction, or condition of the certificate.
(2) The Secretary shall set forth what steps, if any, may be taken by the certificate
holder to relieve the holder of the suspension or enable the certificate holder to
reapply for certification if a previous certificate has been revoked.
