Division access to criminal background information for background screening and

investigation.
(1) The division shall have direct access to criminal background information maintained under Title
53, Chapter 10, Part 2, Bureau of Criminal Identification, for the purpose of:
(a) background screening under this chapter, Chapter 2a, Removal and Protective Custody of
a Child, or Chapter 3, Abuse, Neglect, and Dependency Proceedings, including background
screening of an individual who has direct access, as defined in Section 26B-2-101, to a minor:
(i) who is alleged to be or has been abused, neglected, or dependent; and
(ii) for whom the division has an open case; or
(b) investigation of abuse or neglect under this chapter, Chapter 2a, Removal and Protective
Custody of a Child, or Chapter 3, Abuse, Neglect, and Dependency Proceedings.
(2) Except as provided in Section 80-3-305, the division and the Office of Guardian Ad Litem are
authorized to request the Department of Public Safety to conduct a complete Federal Bureau of
Investigation criminal background check through the national criminal history system (NCIC).
