(1) Terms defined in Sections 76-1-101.1 and 76-9-1301 apply to this section. (2) An actor commits maintaining, committing, or failing to remove a public nuisance if the actor: (a) maintains or commits a public nuisance, the punishment for which is not otherwise prescribed; or (b) willfully omits to perform a legal duty relating to the removal of a public nuisance.
