Unlawful sale of a tobacco product, electronic cigarette product, or nicotine product

(1) (a) As used in this section: (i) "Compensatory service" means service or unpaid work performed by an employee, in lieu of the payment of a fine or imprisonment. (ii) "Employee" means an employee or an owner of a tobacco retailer. (b) Terms defined in Sections 76-1-101.5 and 76-9-1101 apply to this section. (2) An actor commits unlawful sale of a tobacco product, electronic cigarette product, or nicotine product if the actor: (a) is an employee; and (b) with criminal negligence, sells or gives a tobacco product, an electronic cigarette product, or a nicotine product in the course of business to an individual younger than 21 years old. (3) A violation of Subsection (2) is a class A misdemeanor.
