Wrongful commencement of an action in justice court

(1) Terms defined in Sections 76-1-101.5 and 76-8-101 apply to this section. (2) An actor commits wrongful commencement of an action in justice court if the actor: (a) is: (i) a party to a suit or a proceeding; or (ii) an agent or attorney for a party to a suit or proceeding; and (b) except as provided in Section 78A-7-105 or 78A-7-106 , knowingly commences, prosecutes, or maintains an action, suit, or proceeding in a justice court. (3) A violation of Subsection (2) is a class B misdemeanor.
